If there are issues in a newly purchased property, the individuals or legal entities involved in its construction are responsible, and must respond individually or jointly.

1. The developer.

As they are the one who decides, drives, plans and finances the work with their own or third-party resources, either for themselves or for later sale, handover or transfer to third parties.

2. The architect.

This is the professional who designs the home project and certifies that the construction is carried out in accordance with the project.

3. The builder.

They are the one who carries out the work using their own or third-party human and material resources. They are directly liable for material damage caused to the building due to faults or defects arising from lack of skill, insufficient professional or technical capacity, negligence, or failure to comply with the obligations attributed to the site manager and other individuals or legal entities that depend on them. This also applies in the case of subcontracting.

4. The quantity surveyor / technical architect.

The technical architect (aparejador) who oversees the development of the work in its technical, aesthetic, planning and environmental aspects.

The following liability would fall on the parties mentioned above.

  • Who they are liable to: Owners and third-party purchasers (and no others) of the buildings or parts thereof if they are subject to division.
  • What they are liable for: Material damage caused in relation to constructed buildings and works on existing buildings for whose projects the building licence is applied for after the law comes into force.
  • Period during which they are liable: There are three liability periods depending on the type of defects the home presents:
  • 1. Ten years, for defects in the building’s structure.

    2. Three years, for defects affecting construction elements or installations that imply non-compliance with the home’s habitability requirements.

    3. One year, only enforceable against the builder for finishing and workmanship defects.

    Insurance.

    To ensure that the agents can meet any liability that may be required of them, the Law requires damage insurance policies to be taken out in order to:

    – Cover structural damage for ten years. The minimum insured capital will be 100% of the final cost of the material execution of the work, including professional fees. This insurance is mandatory. The notary and the land registrar must not authorise or register public deeds declaring new construction works for buildings unless proof of this guarantee is provided.

    – Cover defects affecting construction elements or installations that imply non-compliance with habitability requirements for three years.

    – Cover material damage or defects due to execution issues affecting finishing elements for one year.

    Claims period.

    Two years from the moment the damage occurs.
